2.1. Definition and Registered Address

These General Conditions regulate the contractual relationship between Eurotokk LTD (hereinafter referred to as “Eurotokk LTD”) and any third party (hereinafter referred to as “User”/”Users”) who uses the website platform “https://eurotokk.com/” (hereinafter referred to as the “Portal”), or purchases products offered through it (hereinafter referred to as the “Products”).

2.2. Special Conditions

These General Conditions do not exclude the possibility of applying Special Conditions to certain products on the Portal. Special Conditions will be additional and will prevail over the General Conditions in case of discrepancies. Products subject to Special Conditions will be subject to the latter, and otherwise, to the General Conditions.

2.3. Acceptance of Terms and Conditions

By making a purchase or placing an order, regardless of the method used, the User expressly acknowledges and accepts these General Terms and Conditions of Contract. These terms and conditions shall remain valid throughout the entire duration of the commercial relationship between the buyer and Eurotokk LTD without the need to mention them again in the future.

2.4. Changes to Terms and Conditions

Eurotokk LTD reserves the right to modify these General Conditions or Special Conditions at any time without prior notice, including the introduction of new conditions. Changes will be published on the Portal’s website for Users to review before continuing to use the Portal. Your continued use of the Portal or purchase of Products after the publication of changes constitutes acceptance of such changes. These changes have been made to adapt our policies to the changing needs of Users and our services. It is recommended to periodically review these General Terms and Conditions to ensure awareness of any changes.

3. USE OF THE WEBSITE

3.1. Age Requirement

To make purchases on the site, the user must be over 18 years of age.

3.2. User Responsibility

Access to a wide range of information and services provided by Eurotokk LTD (hereinafter “the content”) implies that the user is responsible for its use and the necessary registration to access certain services or content. By registering, the user agrees to provide truthful and lawful information.

3.3. Proper Use of Content

The User agrees to use the content provided by Eurotokk LTD through its website properly and agrees not to use it:

Eurotokk LTD reserves the right to remove any comments or posts that undermine the dignity of individuals, discriminate, are xenophobic, racist, pornographic, support terrorism, violate human rights, or are deemed unsuitable for publication due to lack of communication with the website. In any case, Eurotokk LTD, as the website administrator, will take action if it detects actions contrary to these Terms of Use or the Privacy Policy.

4. PRODUCTS AND PURCHASE PROCESS

4.1. Description and Availability of Products

On our website, you will find detailed features and prices of our products, which will be available for sale until stocks last. The prices displayed are in euros and are valid at the time of viewing. Any special offer will be clearly indicated and will be valid while displayed on the page or for the period indicated therein.

4.2. Prices and Purchase Details

All prices listed on the page include legal taxes and will be automatically added to the shopping cart. Any other applicable costs, such as shipping or installation fees, will be transparently displayed in the shopping cart. Additionally, Eurotokk LTD will issue an invoice for all purchases made on the portal. Please note that the order confirmation sent by Eurotokk LTD does not constitute an invoice, but rather a purchase receipt.

4.3. Substitution of Out-of-Stock Products

If a product is not available in our warehouse at the time of your order, we reserve the right to provide you with a product of similar characteristics and of equal or even higher quality, without increasing the price. If you are not satisfied with the delivery, you can request a refund of the amounts paid by contacting our customer service team.

4.4. Manufacturer’s Data Accuracy

It is important to note that the Seller is not responsible for the accuracy of the data provided by the manufacturer of the products.

4.5. Purchase Process

To purchase a product on our portal, it is necessary to complete the registration process using your username and password. Select the product you want, add it to your cart, and follow the detailed instructions to successfully complete your purchase.

4.6. Order Confirmation

By placing an order, you express your intention to purchase the requested product in a binding manner. The contract is official once you receive confirmation that your order has been registered and processed.

4.7. Product Ownership

The goods will remain the exclusive property of the Seller until the total payment of the corresponding amount is made. If the product is purchased by the end consumer, its resale, warranty transfer, alteration, rental, pledge, or any other alienation or modification without the prior express permission of the Seller is prohibited.

5. PAYMENT

To make payment for your orders, you can choose from the following payment methods:

  • Credit or debit card, Visa or Mastercard

    • Through the REDSYS service provider

    • These are 100% secure payments, with only the bank receiving your card details.

  • Bank transfer

    • If you choose this payment method, you will receive an email with the necessary details to make the transfer. We will include the order amount, the concept to be mentioned in the transfer, and the account number of the bank entity you have selected. To ensure the correct handling of your order, make sure to include the order reference number as the payment concept.

    • If you opt for bank transfer, your order will remain active for a period of 7 business days. If we do not receive payment within this period, the order will be automatically canceled.

Once you have made the payment, you will receive a confirmation email to the address associated with your account. To verify the status of your order, you can access your account and select “My Orders”.

6. SHIPPING OF PRODUCTS AND SHIPPING COSTS

6.1. Delivery Times

The delivery time for products in stock is 12 to 48 hours.

6.2. Product Substitution

In the event that the requested product is not available, the seller has the authority to offer a product with similar characteristics and equal or superior quality at no additional cost. If the User is not satisfied with this alternative, a refund can be requested by contacting our customer service.

6.3. Delays Due to Exceptional Circumstances

Delivery times may be delayed due to exceptional circumstances, such as force majeure, transportation problems, strikes, shortage of raw materials, or other similar events. If the delay extends for more than four weeks from the date of contract completion, both parties have the right to terminate the contract.

6.4. Partial Deliveries

If some of the requested products are not available, the Seller reserves the right to make partial deliveries. The costs associated with these partial deliveries will be borne by the Seller, provided that the Consumer agrees to this provision.

6.5 Shipping by Our Transport Company

The goods will be shipped through the transport agencies with which the seller collaborates, selected according to the type of products. Delivery is exclusively made to countries within the continental European Union. Shipping and/or handling costs are not included in the price and will be shown before completing the purchase, depending on the shipping address of each order.

6.6. Fulfillment of Obligations

The Seller reserves the right to terminate the contract and postpone the delivery of the goods if the Customer fails to meet its contractual obligations, especially in case of delay in payment or breach of obligations established in section 4. This action will be taken according to the circumstances and in accordance with the terms and conditions of the contract.

7. WARRANTY AND CUSTOMER SERVICE

At Eurotokk LTD, we pride ourselves on distributing high-quality products that have been extensively tested in the market. Despite their durability, in exceptional circumstances, products may have manufacturing defects. In this section, we will explain when the warranty applies and how to request it.

7.1. Warranty for Parts and Electronic Components

During the warranty period, Eurotokk LTD guarantees the replacement of parts and electronic components on all machines supplied by our company. However, this warranty does not cover natural wear parts or those damaged due to lack of maintenance, cleaning, or improper use of the machine.

7.2. Duration of Warranty

The warranty period varies for each product, and the term is specified in the warranty sheet corresponding to each item.

7.3. Warranty Handling

To manage the warranty, the consumer and user must contact Eurotokk LTD. Some manufacturers directly manage breakdowns/defects/incidents of their products. In this case, the customer can choose to send the product directly to the manufacturer’s technical service at no additional cost. The defective product must be sent to the technical service with a detailed report of the reason for the shipment. Failure to indicate any defect may result in the return of the product without the right to future claims. Warranty processing must follow the instructions provided by Eurotokk LTD upon request, through the corresponding email info@eurotokk.com.

7.4. Consumer Rights

The consumer has the right to complain to the seller in the following cases:

  • When the product does not match the description provided by the seller.

  • If the product is not suitable for the normal uses of similar consumer products.

  • When the product is not suitable for a specific use agreed upon with the seller.

  • If the product does not meet the expected quality and performance, according to the public statements made by the seller or the manufacturer.

7.5. Customer and User Options

The customer and user have the following options:

  • Repair or Replacement: The customer can choose between repair or replacement of the product unless this is impossible or disproportionate. It will be considered disproportionate if the cost exceeds the purchase price. However, non-fungible products cannot be replaced.

  • Both repair and replacement must be carried out within a reasonable period and at no additional cost to the consumer.

7.6. Warranty Shipping Costs

The shipping costs generated by warranty processing will be covered by Eurotokk LTD in cases where the lack of conformity is found in the purchased good. This must be done following the instructions provided by Eurotokk LTD through a prior request and acceptance, usually via the corresponding email.

7.7. Warranty Cancellations

The warranty may be voided in the following situations:

  • Incorrect use, handling, or maintenance by the Customer.

  • Software issues and/or viruses.

  • Components damaged by power surges or electrical overcurrents.

  • Broken or damaged components due to impacts.

  • Incorrect repair, modification, or extension by the customer.

  • Deterioration, removal, or concealment of the warranty label from Eurotokk LTD or the manufacturer.

In summary, damaged products or evidence of improper handling will not be accepted.

7.8. Warranty Exclusions

Excluded from the warranty are:

  • Defects and damages caused by external factors, accidents, primarily electrical accidents, normal wear and tear, and non-compliant use according to the instructions of Eurotokk LTD.

  • Products modified or repaired by the customer or any person not authorized by Eurotokk LTD.

  • Incorrect configuration/installation by the customer of equipment.

  • Incorrect configuration or breakdown in equipment caused by equipment or accessory not provided by Eurotokk LTD and incorporated by the customer.

  • Computer virus infection by the customer.

8. RETURNS, EXCHANGES, AND ORDER CANCELLATIONS

At Eurotokk LTD, we understand that situations may arise where users wish to make returns, exchanges, or cancellations of their orders. Below, we detail our policy regarding this:

8.1. Right of Withdrawal

Users who purchase products through the portal have the right to return, without justification, within 14 calendar days after receiving the product. For this, it is important that the products are unsealed and in perfect condition, meeting the necessary requirements to accept the return.

8.2. Return Process

If you wish to return an item, please contact us by email at info@eurotokk.com and include the order number. Once the return is accepted, we will contact you by email to manage the return or replacement.

8.3. Return Costs

In the case of partial returns of the order, the buyer must manage the shipment at their own expense, and returns with collect charges will not be accepted. If the return is due to defective products, the shipping costs will be borne by Eurotokk LTD. In case of errors on the part of the buyer, the product amount will be refunded, but the transportation costs will be the responsibility of the buyer.

8.4. Refund Time

Once the product’s condition has been reviewed, Eurotokk LTD will refund the amount to the user. Order cancellations made with credit/debit cards will be refunded within 14 business days from the cancellation notification. In some cases, it may take up to 30 days to reflect on the bank statement. Order cancellations by bank transfer may take up to 30 days due to administrative procedures.

8.5. Order Modifications

If you wish to modify an already placed order, contact us by email at info@eurotokk.com. Changes will be possible at no additional cost if the order has not yet been shipped. However, this could delay delivery and affect the order amount and shipping costs. If the order is already in transit, it must be treated as a return or a new purchase.

8.6. Cancellations

Order cancellations can be made within 48 hours of placing the order. If the order has not yet been shipped, it will be canceled without penalty. If it has already been shipped, follow the instructions for a return. Eurotokk LTD reserves the right to cancel an order if it cannot be delivered on time and in the manner due to third parties or errors in the pricing system. In this case, the customer will receive a refund as soon as possible, usually within 48/72 hours.

9. INTELLECTUAL PROPERTY

9.1. Intellectual and Industrial Property Rights

The User acknowledges that all elements of the Portal, as well as each of the Products and Services offered, including the information and materials contained in them, trademarks, the structure, selection, arrangement, and presentation of their contents, and the software programs used in relation to them, are protected by intellectual and industrial property rights of Eurotokk LTD or third parties. The General Conditions do not grant the User any other rights over these industrial and intellectual property rights that are not specifically contemplated in them.

9.2. Restrictions on Use

Without express authorization from Eurotokk LTD or the corresponding rights holders, or unless permitted by law, the User may not perform actions such as reproduction, modification, distribution, rental, loan, or commercial exploitation of the elements of the Portal and the Products and Services. These elements must be used exclusively to meet the personal needs of the User.

9.3. Respect for Property Rights

The User must refrain from removing the identifying signs of rights (whether intellectual, industrial, or others) of Eurotokk LTD or third parties found on the Portal. Additionally, the User must refrain from bypassing or manipulating any technical device established by Eurotokk LTD or third parties on the Portal.

10. RESPONSIBILITIES AND LIMITATIONS

10.1. Termination and Suspension of Access

Eurotokk LTD reserves the right, without prior notice, to terminate its relationship with the User or to suspend its access to the Portal and/or any of the Products and/or Services if usage contrary to these General Conditions or the applicable Particular Conditions is detected.

10.2. User Responsibility

The User assumes responsibility for any direct or indirect damage that Eurotokk LTD may suffer due to non-compliance with the obligations arising from the General or Specific Conditions related to the use of the Portal or the Products and/or Services. Additionally, the User agrees to indemnify Eurotokk LTD against any sanction, claim, or lawsuit that a third party, including public bodies, may file against Eurotokk LTD, its employees, or agents, due to the violation of third-party rights by the User through the use of the Portal or the acquisition of Products and/or Services in violation of the applicable General or Specific Conditions.

10.3. User’s Use at Own Risk

The User acknowledges and accepts that the use of the Portal, as well as the acquisition and use of the Products and/or Services, is carried out at their own exclusive risk and responsibility.

10.4. Eurotokk LTD’s Liability Limitations

Eurotokk LTD does not provide warranties and excludes any liability in the following aspects:

(a) Availability, Continuity, and Operation: Although Eurotokk LTD strives to maintain the availability and continuity of the Portal, it cannot guarantee its operation without interruptions or errors, nor that all errors will be corrected.

(b) Security: Eurotokk LTD implements standard security measures in the industry to protect the confidentiality and security of Portal use, but cannot guarantee the complete absence of unauthorized access.

(c) Viruses and Harmful Elements: Eurotokk LTD takes measures to prevent the presence of viruses or other harmful elements on the Portal, but cannot guarantee their absence or be held responsible for any damages they may cause.

(d) Third-Party Services: Eurotokk LTD does not control or guarantee the products and services provided by third parties through the Portal, including the accuracy, quality, and truthfulness of this information.
